Two lawsuits were also filed during 2015 against the licensee operator of Bay Breeze Health and Rehabilitation Center alleging nursing home negligence with the Sarasota County Clerk of Court.

Bay Breeze Health and Rehabilitation Center is part of a chain of nursing homes operated by Consulate Health Care.  According to its website, this organization operates more than 200 nursing homes in 21 states.  It is one of the top ten largest nursing home operations in the United States.  During 2015, Consulate Health Care’s Chief Executive Officer, Joseph Conte, was replaced by Bill Mathies a former executive with both Sun Healthcare Group and Beverly Enterprises; two large nursing home chains with troubled histories.  Sun Healthcare Group previously filed for bankruptcy while Beverly Enterprises was prosecuted by the United States Department of Justice for submitting false claims for reimbursement under the Medicare and Medicaid programs.  Consulate Health Care has recently seen a number of its facilities placed on the State of Florida’s Nursing Home Watch List.  According to ACHA’s website:  “The Watch List identifies nursing homes that are operating under bankruptcy protection or met the criteria for a conditional status during the past 30 months. A conditional status indicates that a facility did not meet, or correct upon follow-up, minimum standards at the time of an inspection. Immediate action is taken if a facility poses a threat to resident health or safety.”
