When nursing home staff members commit medication errors when administering medication and fail to follow physician orders in caring for nursing home residents, serious consequences and harm can result.  Additionally, bed sores, infections, fractured bones, significant weight loss, dehydration and unexplained deaths are all potential signs of nursing home abuse and neglect.

As a nursing home abuse lawyer who handles elder abuse cases in Sarasota, Venice, Englewood, Bradenton and throughout Florida, I routinely examine complaint and annual survey investigations of area nursing homes.  I also prosecute cases of nursing home abuse and neglect on behalf of families and their loved ones who have been harmed.  I frequently receive calls from Florida citizens who are searching for a good nursing home for the placement of a loved one.  If you are involved in choosing a nursing home in Sarasota County, Manatee County or Charlotte County, Florida, you should know that the State of Florida Agency for Healthcare Administration regulates nursing homes and conducts annual surveys and complaint investigations.  Those nursing homes with a pattern of problems are often placed on the state’s “Nursing Home Watch List.”

On July 27 through July 30, 2015, the State of Florida Agency for Healthcare Administration conducted an unannounced investigation at Crossbreeze Care Center, which is located at 1755 18th Street, Sarasota, Florida  34234.  At that time, state investigators cited Crossbreeze Care Center for failing to meet the guidelines set forth under the Nursing Home Reform Act of 1987 signed into law by President Ronald Reagan, as well as Florida’s Administrative Code.  Those citations of deficiencies against Crossbreeze Care Center included:

F332              Failing to ensure that the facility is free of medication error rates of five percent or greater.

F356              Failing to ensure requirements for staff posting of work hours are met.

F431              Failing to safeguard and store medication in a clean and sanitary manner.

F441              Failing to establish and maintain an Infection Control Program designed to provide a safe, sanitary and comfortable environment and to help prevent the development of and transmission of disease and infection.

N 054            Failing to follow physician orders as prescribed, and if not followed, document the reason in the resident’s medical record.

The complete survey investigation is available for review at www.floridahealthfinder.gov.  Nursing home facilities like Crossbreeze Care Center are required to comply with the above provisions that are contained within the Nursing Home Reform Act of 1987 in exchange for receiving taxpayer money through Medicare and Medicaid.  Sarasota Nursing home abuse and neglect lawyer, James Keim, seeks to hold those nursing homes accountable for the serious harm they cause by failing to follow the law and neglecting and abusing the most frail and vulnerable citizens in Florida which they are obligated to protect.  Remember to always decline, cross out and say “ no thanks” to arbitration clauses contained within nursing home admissions agreements.
